What is becoming clear as the Obama Administration moves forwards
with new rules and regulations is that marriage equality at the federal
level will impact all fifty states. For example, if you are a couple in
Mississippi where no marriage equality exists and get married in New
York City, you will be able to receive most federal benefits, rights and
protections. Although you won't be able to receive the same at the
state level.
The big area that needs to be worked out and maybe corrective legislation might be needed is around Social Security.
Within a week, anti-LGBT rules and regulations have been falling left and right.
The Defense Department has issued sweeping rulings removing all
barriers to LGBT soldiers and their spouses. Now LGBT bi-national
couples can apply for green cards if they are married in any of the
thirteen states that allow marriage equality. Almost every agency in
the federal government are now changing their regulations to include
same sex couples.
The speed that the Obama Cabinet is moving is simply astounding and breath-taking.
Even the courts are now making decisions based on the Supreme Court
decisions. A Federal Judge in Michigan has now ruled based on the 14th
Amendment that a major case to repeal Michigan's prohibition against
marriage equality can now go forward.
My guess our legal teams will be extremely busy over the next six months and we are in some real surprises with decisions.
President Obama and his team deserve high praise for being prepared
for this decision, moving quickly in the name of justice and not worried
about the political consequences. It is refreshing and exciting to
witness in this historical week. Thank you Mr. President!
